This agreement covers automated and non-automated SMS messages sent in compliance with the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and Twilio’s A2P 10DLC requirements.

Upon opting in, you may receive SMS messages from Sailing & Boating LLC that include, but are not limited to:

Marketing, promotional, or informational messages related to our products and services

Message frequency may vary based on your engagement and preferences.

2. Opt-In and Consent

By providing your mobile phone number, you expressly consent to receive recurring SMS messages at the number provided. Consent is not a condition of purchase.

4. How to Opt Out

All messages are subject to monitoring, filtering, and enforcement under CTIA and carrier guidelines.

7. Supported Carriers and Delivery Disclaimer

SMS messaging is available through most major U.S. carriers. However, delivery is not guaranteed and may be delayed or blocked due to carrier limitations, network issues, device compatibility, or factors beyond our control.

Sailing & Boating LLC is not liable for delayed or undelivered messages.

8. Age Restriction and Eligibility (18+)

This SMS messaging service is intended only for individuals who are at least eighteen (18) years of age.

By opting in, you represent and warrant that:

You are 18 years of age or older

You are legally authorized to consent to receive SMS messages

You are the subscriber or authorized user of the phone number provided

We do not knowingly send SMS messages to individuals under 18. If we learn that a subscriber is underage, we will promptly remove the number from our messaging program.

9. Changes to These Terms

We reserve the right to update or modify these Terms and Conditions at any time. Changes will become effective upon posting with an updated effective date. Continued participation in our SMS program constitutes acceptance of the revised terms.
